Press Release: LPHC praises court ruling

The Libertarian Party of Henry County is praising the recent decision by the Georgia Court of Appeals which upheld an April 2006 ruling by Henry County Superior Court Judge Arch McGarity that threw out the condemnation of Stockbridge Florist & Gifts, owned by Marks and Regina Meeks.

“This isn’t over,” said LPHC Chairman Jason Pye, “the City of Stockbridge has grossly violated the spirit of the Constitution and the liberties protected under it. The Henry County Libertarian Party will actively work for new leadership in the city in the upcoming elections and we urge the two mainstream county parties and civic organizations to work together to achieve this goal.”

LPHC Vice Chairman Richard Schrade added, “The Court of Appeals decision is major victory for private property rights in the State of Georgia and will hopefully be a harbinger of things come, including the restoration of private property rights as the Founding Fathers envisioned it.”

The Libertarian Party of Henry County is also calling for the Georgia General Assembly to close loophole left open by last year’s amendment to the Georgia Constitution, which points to general law for the definition of blight. General law is subject to the state legislature and can be change at anytime during a legislative session by majority vote.
